Terms of Service

Last updated: October 8, 2026

1. What Oh My Mark is

Oh My Mark is software that helps you research, prepare, track and maintain U.S. trademark applications. It performs searches, prepares documents from the information you provide, monitors public USPTO records and reminds you of deadlines.

2. Oh My Mark is not a law firm

Oh My Mark is not a law firm and does not provide legal advice. Using Oh My Mark does not create an attorney-client relationship. Information and drafts produced by the software, including AI-generated content, are not a substitute for the advice of a licensed attorney. Where an independent attorney from our partner network provides services, that attorney’s engagement is between you and the attorney, under their own engagement terms.

3. Your responsibilities

4. Search results

Clearance searches are preliminary screens of available records. They do not cover every possible conflict (for example state registrations, unregistered common-law use or foreign rights) and are not an opinion on whether a mark is available or registrable.

5. Fees

Service fees are shown before you pay and are charged per application. USPTO government fees are separate and are paid by you directly to the USPTO. Service fees are refundable within 14 days if no filing packet has been generated for the application.

6. Acceptable use

Do not use Oh My Mark to file applications for marks you do not own or intend to use, to submit false statements, or to interfere with the service.

7. Limitation of liability

To the extent permitted by law, Oh My Mark’s total liability for any claim relating to the service is limited to the service fees you paid for the application concerned. Oh My Mark is not liable for the outcome of any USPTO proceeding.

8. Changes and contact

We may update these terms and will notify you of material changes. Questions: support@ohmymark.com.
